Professional Liability

Liability insurance or "errors and omissions coverage" that is available to professionals, such as lawyers, medical care providers, accountants, insurance agents, architects, engineers and others, requires special attention. Because of the nature of the coverage, the client is by definition a professional with a stronger personal interest in the outcome of the case, which could have a bearing on their livelihood.

We handle professional liability claims on behalf of insureds and insurers, including both defense and coverage assignment. In defending such claims, we follow the firm's overall litigation philosophy, which emphasizes early investigation and analysis to determine liability and damage potentials.

For example, recognizing the very personal nature of a malpractice suit and its effect on the professional, we work closely with the client, as a partner in the process, to handle the case and regularly report its status through the life of the litigation. By providing consistent communication and guidance to the client, we make every effort to minimize the client's exposure through litigating not only the malpractice issues but the underlying case as well. This approach provides both the insured and the insurer with an ongoing understanding of the strengths and weaknesses, thus allowing for more informed decision-making on resolution or trial.

On the coverage side, the firm assists carriers through comprehensive research and analysis in evaluating coverages or potential coverages under the policy. By accurately analyzing and evaluating coverage at the outset, carriers are better equipped to respond to their insureds in a reasonable and timely fashion. When necessary and appropriate, the firm actively litigates coverage actions.
